Terms of Service
📝 This is a first draft written to match how VivaWhiz actually works today. Have it reviewed by a lawyer before relying on it for a public launch, especially the subscription-billing and children's-account sections.
1. Who We Are
VivaWhiz is a brand owned and operated by AIVantage LLC ("VivaWhiz," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the VivaWhiz app and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
2. Who Can Use VivaWhiz
VivaWhiz is designed for learners of all ages, including children. Children under 13 in the United States (and equivalent ages under other countries' laws) may only use the Service with verified parental consent, as described in our Privacy Policy. A parent or guardian who provides consent for a child is responsible for that child's use of the Service under these Terms.
3. Accounts
- You're responsible for keeping your account credentials (or, for a child's account, their PIN) confidential.
- Account display names are auto-generated and never based on a real name, for every account regardless of age — see our Privacy Policy for why.
- You can delete your own account at any time from Profile → Settings → Delete My Account. Parents can request deletion of a child's account by emailing privacy@vivawhiz.com.
4. Subscriptions & Billing
Some content in VivaWhiz is available to try for free in a limited preview; full access requires a paid annual subscription.
- Payment: Subscriptions are purchased and billed through the Apple App Store or Google Play, using whichever payment method you have on file with that store. VivaWhiz does not collect or store your payment card details directly.
- Pricing: Subscription price varies by country/region and is shown before purchase in the app. Introductory prices may be offered to new subscribers and may change for future subscribers without affecting an already-active subscription's price.
- Renewal: Subscriptions renew automatically at the end of each term unless cancelled at least 24 hours before the renewal date, through your Apple ID or Google Play account settings (not through VivaWhiz directly).
- Cancellation: You can cancel anytime through the App Store or Google Play. Cancelling stops future renewals; it does not refund the current billing period.
- Refunds: Refund requests are handled by Apple or Google under their own refund policies, since they process the payment. We're happy to help point you to the right place if you email support@vivawhiz.com.
5. Acceptable Use
Please don't use VivaWhiz to:
- Attempt to access another user's account without their permission
- Interfere with or disrupt the Service (including attempting to bypass subscription checks or content locks)
- Upload or transmit anything unlawful, harmful, or that impersonates another person
- Reverse-engineer, scrape, or resell the Service's content
6. Content
All quiz content, artwork, branding, and educational material in VivaWhiz belongs to AIVantage LLC or its licensors. Your subscription gives you a personal, non-transferable right to use the Service — it doesn't transfer ownership of any content to you.
7. Changes to the Service
We may add, change, or remove content and features over time (including which countries and categories are available), and may update these Terms. We'll notify users of material changes; continued use after a change means you accept the updated Terms.
8. Disclaimer & Liability
VivaWhiz is provided "as is." While we work to keep content accurate and the Service reliable, we don't guarantee it will be error-free or uninterrupted. To the extent permitted by law, AIVantage LLC isn't liable for indirect or incidental damages arising from your use of the Service.
9. Governing Law
These Terms are governed by the laws applicable to AIVantage LLC's place of registration, without regard to conflict-of-law principles.
